CITY OF NEWBURGH — A Newburgh firefighter became an ad hoc surgeon Friday, called upon to use a pneumatic saw to cut a piece of steel pipe off a 73-year-old man’s penis.
Firefighters were dispatched to the Newburgh campus of St. Luke’s Cornwall Hospital shortly after 9 p.m. for a public service call, Assistant Chief Scott Mandoske said. Hospital personnel asked them for tools to cut off a ring. The fire department has a ring cutter used to clip wedding bands from swollen fingers, but firefighters learned that wouldn’t be enough. The pipe was an inch long, an inch in diameter and made of quarter-inch-thick steel.
Authorities said the pipe was apparently an erotic aid, but did not elaborate.
Medical personnel weren’t able to perform typical medical procedures, such as forcing blood from one side of the penis to the other in order to pull the pipe off. The man’s penis had swollen and turned purple.
Mandoske said firefighters chose a “wizzer saw” for the job. The wizzer saw is an automotive tool, powered with air bottles and adopted by emergency responders who frequently deal with car crashes. Firefighters use it more commonly to saw off mufflers.
This was to be a more delicate operation.
Hospital staff prepared the man, who was unidentified, by wrapping the skin and sliding a lubricated tongue depressor between the pipe and the man’s penis to protect him. A doctor, nurses and a paramedic gathered in the Emergency Room as a firefighter — “one of the new guys” — prepared to begin the operation.
“Just don’t cut it off,” the senior citizen reportedly said.
For more than 90 minutes, the firefighter sawed bit by bit into the pipe, pausing occasionally to cool the saw. The time duration was critical, Mandoske said. Hospital staff worried the man could lose his penis if blood circulation was cut off too long.
The wizzer saw emptied the first bottle of air and then a second. Finally, after five air bottles, the saw clipped through the final bit of pipe, and they were able to free the man. He was apparently unharmed by the operation, Mandoske said, although the assistant chief didn’t press for details.
A chef was found guilty yesterday of murdering a former boyfriend and cooking his flesh.
Anthony Morley, 36, a former Mr Gay UK, had slashed Damian Oldfield’s throat before stabbing him several times after they went to bed together in April. He left a bank card over a wound on his victim’s chest.
Morley was arrested after he walked into a takeaway restaurant near his home in Leeds wearing a bloodstained dressing-gown and flip-flops and told staff there that he had killed someone who had tried to rape him.
The murder was described during a two-week trial at Leeds Crown Court as “terrible, horrific and bizarre”.
The jury was told that Morley and Mr Oldfield, 33, from Bramley, Leeds, who sold advertising space in a gay lifestyle magazine, had previously had a relationship.
On the day of the murder the pair had exchanged text messages and Morley, who was the first winner of the Mr Gay UK title in 1993 even though he had a girlfriend at the time, claimed that he was not happy with his sexuality.
In his text messages, Morley said that he would like to try to resume their relationship but that he wanted to take things slowly. The two men met in Leeds before later going back to Morley’s house, where he prepared a meal for Mr Oldfield.
The pair went to bed after drinking and Morley claimed that Mr Oldfield had assured him nothing would happen between them. But he said that he awoke to find the other man performing a sex act on him.
The court was told that Morley had been scarred for life after being groomed and raped by an older man when he was younger and that the incident had left him confused about his sexuality.
He told the jury that he had had a flashback to that incident and said he felt betrayed by Mr Oldfield’s actions and feared that he might be raped.
Morley said he did not know why he had gone on to kill Mr Oldfield, and claimed to have no memory of attacking his former boyfriend other than feeling pain when he cut his own finger with the knife.
He denied murder on the grounds of provocation or diminished responsibility.
He told the court that he could not remember carving and cooking sections of Mr Oldfield’s body but said that he might have done so because he thought he was preparing a piece of meat at work.
When police searched the house they found a chopping board with six pieces of Mr Oldfield’s cooked flesh.
A bundle of fresh herbs, a knife used to chop them, some olive oil and a dish of seeds were found on the work surface near the cooker and a frying pan was on the hob with the remnants of fried herbs and oil in it.
Cheers and applause broke out from the packed public gallery as the jury, which had deliberated for two hours and 20 minutes, returned a verdict of guilty. Morley clasped his hands and bowed his head. Several jury members left the court in tears.
Judge James Stewart, QC, said that he would sentence Morley on Monday.
After the verdict, Mr Oldfield’s mother, Denise, said of her son in a statement: “We shared a special bond, which I can still feel, but now I’m only left with memories and that’s not good enough.
“Damian loved life and he has had that taken away from him in the cruellest of circumstances. He was so easygoing and friendly that to know Damian for five minutes was to know Damian as a friend.
Was Austrian far-right leader Joerg Haider secretly gay?
Speculation that he led a double life raged this week after his political protege, Stefan Petzner, publicly called Haider “the man of my life” in a tearful tribute to the former Freedom Party boss killed in a car crash earlier this month.
Petzner, 27, did not say explicitly that he and Haider, a 58-year-old married father of two, were gay or had a sexual relationship.
But Petzner’s tears and the tone of his remarks — along with photographs purportedly showing Haider in a gay bar on the eve of his death — have raised questions about whether the ultraconservative nationalist had something to hide.
“This can’t go on,” said Michael Fleischhacker, editor-in-chief of the daily Die Presse.
“Stefan Petzner needs to make a decision: Either he describes what was so special about his relationship with Joerg Haider, or he stops publicly playing the role of Haider’s successor and widow,” Fleischhacker wrote in his blog.
Haider died Oct. 11 after crashing his car in the southern province of Carinthia, where he was governor. Investigators say he was drunk and speeding at twice the posted limit when the car plowed into a concrete post and flipped.
Haider was alone in the vehicle, and although authorities have said there is no evidence to suggest foul play, his widow has refused to have Haider’s body cremated until independent forensics experts take another look at the remains.
In death, as in life, Haider remains steeped in controversy.
When his Freedom Party won 27 percent of the vote in 1999 elections, and joined Austria’s coalition government early in 2000, the European Union slapped the country with months of diplomatic sanctions in protest of statements by Haider that came off sounding anti-Semitic.
Though Haider praised aspects of Hitler’s labor policies, criticized immigrants as lazy, criminal and corrupt, and seemed contemptuous of Jews, neither he nor his party ever said anything derogatory about homosexuals, or made traditional family values a key campaign theme.
Haider had left the Freedom Party to form the somewhat more moderate Alliance for the Future of Austria, and Petzner, his deputy, succeeded him as party chief after Haider’s death. Together, the two rightist parties won about 29 percent of the vote in last month’s parliamentary elections.
Within hours of the fatal crash, Petzner went on national television. Sobbing, he declared: “For us, it’s like the end of the world.”
That in itself struck some as a bit unusual. But late last week, in an emotional interview broadcast on Austrian radio, Petzner went further.
“We had a special relationship that went far beyond friendship,” he said. “Joerg and I were connected by something truly special. He was the man of my life … I loved him as a best friend.”
Petzner chose his words carefully, and what he really meant remains open to interpretation. He called Haider his “Lebensmensch” — a term in German that could suggest an intimate relationship, but also could be used to describe an icon or a mentor.
Calls by The Associated Press to Petzner’s cell phone seeking comment went unanswered Friday.
In recent days, several Austrian newspapers and the respected news weekly Profil have published grainy photos they say show Haider in the Stadtkraemer — a gay bar in Klagenfurt, the provincial capital of Carinthia.
Haider’s widow, Claudia, and two married daughters have refused to comment, and his party insists his relationship with Petzner was purely platonic. Petzner was passed over this week as the Alliance’s floor leader in parliament, but he remains the bloc’s boss.
Party officials said Friday the controversy was not a factor in the decision to snub him as floor leader, noting that Haider also didn’t serve in that capacity.
For decades, rumors had swirled that Haider might be gay. Some had even taken to calling his political bloc the “Boys’ Party” because Haider’s entourage often included a bevy of tanned young men.
Austrians, however, are fiercely protective of what they call the “sphere of privacy” — a no-go zone that many feel applies as much to public figures as to ordinary citizens.
Others, like businessman Thomas Neuhold, contend a politician’s sexual orientation is irrelevant.
“I believe it’s been well-known for a long time that Joerg Haider was gay, and to be honest, I’m completely OK with that. We’re living in 2008,” he said.
“If more homosexual politicians would out themselves, it would be a great thing for Austria.”
More than 600 adults have been arrested in raids across the US targeting people who force children into prostitution.
Operations took place in 29 cities in a co-ordinated action involving federal, state and local law officers, according to the FBI.
Officials said 12 large-scale prostitution rings were dismantled in the raids and 47 children rescued.
Since 2003, 575 child prostitutes have been saved from exploitation by American criminal gangs, they added.
Officials said many of the prostitution rings broken up were operated through call centres, truck stops, casinos and websites.
The FBI generally gets involved in child prostitution cases that cross state lines.
At a news conference announcing the results of Operation Cross Country II, FBI Deputy Director John Pistole said the arrests were made possible by intelligence gathered during similar raids in June.
“Sex trafficking of children remains one of our most violent and unconscionable crimes in this country,” he said.
The 47 rescued children range in age from 13 to 17, and all but one are female.
Of these, Mr Pistole said, 10 had been reported to the National Center for Missing and Exploited Children.
A total of 642 people were arrested. They included 73 pimps and 518 adult prostitutes, according to the FBI.
Growing problem
Correspondents say child prostitution has become an urgent issue in recent years, as demonstrated by the growth of online networks where pimps advertise youngsters to clients.
A recent University of Pennsylvania study estimated that nearly 300,000 children in the US are at risk of being sexually exploited for commercial purposes.
“Make no mistake, the minors who were interdicted as a part of this operation are victims of the most extreme form of sex trafficking,” said acting Assistant Attorney General Matthew Friedrich.
“It sadly remains the case even now in 2008 that there remain instances of children in the United States manipulated into prostitution by pimps willing to make a fast buck based on the most vulnerable among us,” he said.

In court documents unsealed Monday, officials with the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives linked two men to the plot.
The men allegedly planned to kill 88 black people, 14 of them by decapitation, according to court documents. Earlier reports had mistakenly said the plot involved killing 102 people.
The numbers 88 and 14 are symbolic to neo-Nazi groups, referring to “Heil Hitler” and a 14-word slogan often citied in racist propaganda.
Jim Cavanaugh, special agent in charge of the Nashville field office for ATF, claimed that the two men planned to finish their killing spree by murdering Obama.
“They said that would be their last, final act — that they would attempt to kill Sen. Obama,” he told The Associated Press. “They didn’t believe they would be able to do it, but that they would get killed trying.”
Allegations against the two men — Daniel Cowart, 20, of Bells, Tenn., and Paul Schlesselman 18, of West Helena, Ark. — have not been proven in court.
Officials with ATF said they seized weapons from the pair, including a rifle, three pistols and a sawed-off shotgun.
Cowart and Schlesselman are charged with possessing an unregistered firearm and threatening a candidate for president. They are also accused planning to steal more weapons for the plot.
Agents with ATF said it appears the two men were acting alone. In court documents, it’s alleged Cowart and Schlesselman “planned to drive their vehicle as fast as they could toward Obama shooting at him from the windows.”
“Both individuals stated they would dress in all white tuxedos and wear top hats during the assassination attempt,” the court complaint states. “Both individuals further stated they knew they would and were willing to die during this attempt.”

A John McCain campaign volunteer made up a story of being robbed, pinned to the ground and having the letter “B” scratched on her face in a politically inspired attack, police said Friday.
Ashley Todd, 20-year-old college student from College Station, Texas, admitted Friday that the story was false, police said.
Maurita Bryant, the assistant chief of the police department’s investigations division, said Todd is being charged with making a false police report.
Police doubted her story from the start, Bryant said.
“She just opened up and said she wanted to tell the truth,” Bryant said, according to the Pittsburgh Tribune-Review. “She was upset with the media for blowing this into a political firestorm.”
Todd, who is white, initially told police she was attacked by a 6-foot-4 black man Wednesday night.
She told investigators she was attempting to use a bank branch ATM when the man approached her from behind, put a knife with a 4- to 5-inch blade to her throat and demanded money. She said she handed the assailant $60 and walked away.
Todd claimed that she suspected the man then noticed a McCain sticker on her car, became angry and punched her in the back of the head, knocking her to the ground and telling her “you are going to be a Barack supporter,” police said.
She said he continued to punch and kick her while threatening “to teach her a lesson for being a McCain supporter,” police said. She said he then sat on her chest, pinned her hands down with his knees and scratched a backward letter “B” into her face with a dull knife.
Todd also told police she didn’t seek medical attention, but instead went to a friend’s apartment nearby and called police about 45 minutes later.
On Friday, when she admitted the story was fabricated, Todd told police she believes she cut the backward “B” onto her own cheek, but she didn’t explain how or why, Bryant said.
“She said she doesn’t remember doing it but knows it must have been her who did it,” Bryant said, according to the Tribune-Review.
Todd reportedly said she thought of Barack Obama when she saw the “B” on her cheek and minutes later “came up what a plan” to manufacture the story, according to Bryant.
She now tells investigators she was neither robbed nor attacked.
“We had some serious cases going on, and this wasted so much time,” Bryant said. “Our detectives have been working through the night just to verify the information we suspected was false from the beginning.”
Bryant said somebody charged with making a false report would typically be cited and sent a summons. But because police have concerns about Todd’s mental health, they are consulting with the Allegheny County District Attorney. She remained in custody and was awaiting arraignment.
Todd worked in New York for the College Republican National Committee before moving two weeks ago to Pennsylvania, where her duties included recruiting college students, the committee’s executive director, Ethan Eilon, has said.
Eilon declined to comment on the investigation Friday or to help The Associated Press contact Todd.
Police investigating the alleged attack quickly noticed some inconsistencies in Todd’s story and administered a polygraph test, CBS station KDKAreports.
Authorities declined to release the results of that test, but investigators said they received photos from the ATM machine and “the photographs were verified as not being the victim making the transaction.”
Police say they do not believe any other people were involved. They said Todd’s friends believed the story about the attack.
Police suspected all along that Todd might not be telling the truth, starting with the fact that the “B” was backward, Bryant said.
“We have robbers here in Pittsburgh, but they don’t generally mutilate someone’s face like that,” Bryant said. “They just take the money and run.”
Miss Teen Louisiana lost her crown 11 days early after being arrested on charges of leaving a restaurant without paying and carrying marijuana. RPM Productions Inc., the sponsor, took back the title on Tuesday after learning that Lindsey Evans, 18, of Blanchard, had been arrested, president Paula M. Miles said Wednesday.
Evans will have to return her sash and crown, but won’t have to return any other prizes or cash equivalents, Miles said.
“She’s done a good job this year,” Miles said.

BURLINGTON, Vt. – Berated as “evil” and “the lowest of the low,” a man convicted of killing a college senior after a chance encounter was sentenced Friday to life without parole, despite proclaiming his innocence to the end. Brian L. Rooney, a 38-year-old construction worker and father of three, fought back tears as he expressed condolences to the mother and father of Michelle Gardner-Quinn but said he wasn’t her killer.
“I am so sorry for what you are going through, but I am not the man responsible for this tragic event. And it saddens me to have to tell you that,” he said.
Gardner-Quinn was 21 and had just transferred to the University of Vermont when she happened upon Rooney on a downtown Burlington street Oct. 7, 2006. Her cell phone had gone dead and she asked to borrow his. They were seen on surveillance camera images walking past a jewelry store, but she vanished after that.
Six days later, her half-dressed body was found covered with leaves and stuffed into a rock crevice at scenic Huntington Gorge.

Westwood Village, Los Angeles, CA—It was 11:30 PM Friday when a heavily armed homeless man pulled out a pistol and fired it at a traffic signal and concrete wall. This happened on a deserted corner of Le Conte and Broxton Avenues.
Gene Carlton Bush, 52, is a well know local guy who was recognized for his art-work. His friends called him “Dutch”. At least one local restaurant, The Habibi Cafe utilized his services to decorate the popular eatery. Bush was apparently living in his van with his gun collection. Bush has no known criminal record. Nobody can guess just what crisis prompted his behavior.
For whatever reason, Bush fired a few shots in what can only be described as a non-threatening manner to get police attention. Was Bush trying to commit, “Suicide By Cop?” Soon the UCLA police responded and using minimal force and a Taser they subdued him. Reportedly Bush has been making anti-government statements. I suspect he was only parroting words heard at the recent Democratic National Convention.
A subsequent search of Bush’s White Ford van revealed 10,000 rounds of ammunition and writings police suggest is a manifesto of sorts called, “The Secret”. Okay he writes! Maybe he was trying to pull off a Hollywood publicity stunt to sell his writings.
Bush could have gone on a deadly rampage at one of the restaurants nearby or the always crowded Starbucks coffee house. Instead Bush used a quiet corner for this drama.
I spoke with Saad Fathi, the owner of The Habibi Café who has known Bush for several years. “Dutch was reliable, honest, friendly and has never shown anger or violence” said Fathi. He was able to replicate the difficult Arabic script on Fathi’s walls and he painted the catering trucks too.
I asked Fathi if he had enough faith in Bush to post his bail. “I’d bail him out in a minute if he asked me” Fathi responded.
In any event I suspect the local media will make a big deal out of this incident where nobody was hurt or really threatened. Bush needs little time out way from his guns, not a jail cell. We can only hope Bush gets whatever help he needs and deserves.
As for the UCLA cops I must commend them for professionalism because they were able to bring a peaceful end to Bush’s emotional crisis. Bravo, UCLA PD.

The trial of three men accused of deliberately injecting 12 men with HIV-infected blood is due to start in the northern Dutch city of Groningen this week.

The public prosecution office claims it has sufficient evidence to prove that the suspects, Peter M. (50), his partner Wim D. (49) and Hans J. (35), infected 12 men by injecting them with a cocktail of their own blood – all three suspects are HIV-positive – in the period between 2005 and 2007.
The three men have been charged with intentionally causing grievous bodily harm, which carries a maximum sentence of 12 years in prison. They also face a number of assault charges, which have a maximum eight year sentence, and possession and use of illegal drugs. Peter M. is also accused of stealing materials from the nursing home where he worked.
Neither the prosecution not the defence will disclose whether the defendants are to plead guilty or not guilty.
Chat rooms
The suspects came into contact with a number of men via internet chat rooms and invited them to sex parties where they drugged them with the party drug GHB and ecstasy. Most victims had little or no recollection of what happened after they were drugged.
The key legal question is whether it can be proved that the victims were infected with the HIV virus during these sex parties or elsewhere. The Dutch high court has ruled on four similar HIV cases, but these involved people who had had unsafe sex and had failed to inform their partners that they were HIV-positive.
In these cases the high court ruled that having unsafe sex without telling your partner of your HIV status did not in itself amount to causing grievous bodily harm. One of the reasons was that HIV is no longer considered a fatal disease.
Contaminated blood
During the upcoming case, three virologists will provide expert evidence. Kirsten Smit, spokeswoman for the Groningen public prosecution office: “The comparison of viruses will play an important role in this case. The virologists have compared the strains found in the blood of the suspects and those in the victims.”
The aim is to establish which of the defendants caused the infection and whether being infected by HIV through unprotected sex is more or less serious than being injected by contaminated blood.
The suspects were arrested in May 2007 but the complexity of the case and the large number of victims means the case has taken until now to come to court.
Financial compensation
Peter M. is considered the main suspect and the organiser of the sex parties where the offences took place.
His lawyer, Wim Anker, says the case is “legally and medically extremely complicated”. He says it will be difficult to prove that the victims’ HIV infections victims were caused by one of the three suspects.
A civil case for financial compensation is also being brought by the 12 victims and an additional two, who all claim they developed medical problems after the sex parties. Their lawyer in the civil case, Fred Kappelhof, is asking for “considerable sums” in damages for his clients.

Sperm counts are falling dramatically across Britain and the rest of industrialised world, and scientists are increasingly convinced that pollution is to blame.
Studies around the world have shown that average sperm counts in men have dropped by more than half over the past 50 years – from about 160 million per millilitre of semen to 66 million.
The Medical Research Council reports that the fertility of Scottish men born since 1970 was 25 per cent less than those born in the 1950s, with sperm counts continuing to drop by two per cent a year.
Other research by the US Government’s Environmental Protection Agency shows that, proportionately, a man now produce only about a third as much sperm as a hamster.
Scientists increasingly blame a whole class of hormone-disrupting chemicals. Evidence suggests that they cause cancer and damage the immune system, as well as impairing fertility. And they are ever more ubiquitous.
DDT and other pesticides disrupt hormones, as do PCBs, used in countless products worldwide, from plastics and paint to electrical equipment.
Other components of plastics have been found to leach hormone-disrupters including phthalates, which have been found in a wide range of foods including baby milk.
Furthermore, an investigation by the BBC’s Countryfile and The Independent on Sunday has revealed research, to be published this month, that shows that artificial oestrogens, used in contraceptive pills and emitted through sewage works, appear to be changing the sex of half the fish in Britain’s lowland rivers.
Scientists and environmentalists fear that the powerful chemicals are getting into drinking water and affecting human fertility. One third of Britain’s drinking water comes from rivers; most of it is taken from below sewage works.
The Environment Agency denies that there is any danger. Water UK, which represents the water companies, says that no hormone-disrupting chemical has ever been detected in British drinking water, and that fish placed in the water to test it did not become feminised.
But some scientists say that the chemicals may not have been detected, because there is no routine testing for them in drinking water, and because the equipment used in Britain is not sensitive enough.
Research at the University of Ulm, in West Germany, using more sophisticated techniques, found small amounts in four out of every 10 samples tested. And environmentalists fear that effects in people may occur over much longer periods than those used to test the fish.
Dr Susan Jobling of Brunel University, who led the research, says: “Unlike in fish, it is going to take 20 years to see if my children have been affected by developmental exposure to this same cocktail of chemicals.”

NEW YORK – We’ve already seen the baby pictures — now see the photo of Angelina Jolie apparently breastfeeding on the cover of W magazine.
Jolie appears on the cover of the W’s November issue in a sleeveless top, which has been opened to reveal part of her left breast and a tiny hand ostensibly belonging to one of her twins, Knox Leon and Vivienne Marcheline, who were born in July.
The black-and-white photo shows Jolie smiling, her long brown hair cascading over her shoulder. The cover headline promises exclusive “private photos” of the 33-year-old actress by her partner Brad Pitt.
Jolie last caused a stir when she wore a white nursing bra underneath her tank top on the cover of People magazine after she and Pitt welcomed daughter Shiloh, now 2 years old.
Another breast-feeding cover that got people talking was in the summer of 2006, when Babytalk magazine published a photo of a baby and part of a woman’s breast in profile. The magazine conducted a poll of more than 4,000 readers; a quarter of responses were negative, finding the photo inappropriate.
La Leche League International, the world’s oldest breast-feeding support organization, applauds Jolie’s apparent decision to be photographed nursing.
“Breast-feeding in public reveals a whole lot less than what has been revealed on the red carpet. … I think we do need more role models like Angelina Jolie willing to be photographed and say, ‘Hey look, it can be done, it oughta be done,’” said La Leche spokeswoman Jane Crouse.
Besides Shiloh and the twins, Pitt and Jolie also are parents to three adopted children: Maddox, 7, from Cambodia; Pax, 4, from Vietnam; Zahara, 3, from Ethiopia.
Exclusive photos of the Jolie-Pitt clan have fetched millions of dollars. Last summer, People magazine and the British tabloid Hello! paid $14 million in a joint deal to publish the first shots of the family with newborn Knox and Vivienne. Jolie and Pitt allowed such access in exchange for a donation to charity.

How is this pervert’s behavior different from white terrorists who rape, torture and kill civilians?
On Friday in Tampa, Florida, Paul F. Little was sentenced by a federal judge to 3 years and 10 months in a federal prison after being convicted of the grave and terrible crime of distributing pornography “over the Internet and through the mail” — films featuring only consenting adults and distributed only to those consenting adults who chose to purchase them. Even though he lived and worked in California, the Bush DOJ dragged him to Tampa, Florida in order to try him under Tampa’s “community standards,” on the theory that his website used servers physically based in Central Florida and some of the films were sent to Tampa customers who purchased them.
These porn prosecutions are the by-product of the demands from Senate Republicans such as Orrin Hatch, who simultaneously argue that (a) the Threat of Muslim Terrorism is so grave and “transcendent” that we must dismantle our entire Constitutional system and turn ourselves into a lawless surveillance state in order to combat it, and (b) the FBI and DOJ should use their resources to prosecute American citizens who produce consensual adult pornography. The same Alberto Gonazles who decreed the Geneva Convention to be a quaint relic in order to legalize torture announced in 2005 that adult pornography prosecutions would be his “top priority” as Attorney General (at his confirmation hearing, Michael Mukasey assured Hatch he shares the same concerns about “mainstream, adult pornography” as Gonzales did).
Because the films which Little produced included scenes involving sadomasochism, the Bush DOJ alleged, and the federal court found, that the films were not merely pornographic, but also “obscene,” and thus illegal (Little’s lawyers argued, unsuccessfully, they were intended primarily for distribution in Europe, where such films are legal). Ironically, Little’s defense to the obscenity charges was quite similar to the defense which the Bush DOJ itself, years earlier, had embraced in order to claim that Bush officials were not engaged in “torture” when subjecting helpless detainees to gruesome treatment: namely, because the acts in question didn’t involve the infliction of severe pain, they weren’t illegal:
In seeking a more lenient sentence, one of Little’s attorneys argued that the videos were not sadomasochistic. “Urine and vomit, our argument is, isn’t sadistic or masochistic,” James Benjamin said.“What about humiliation?” the judge asked.
That, Benjamin replied, isn’t in the legal definition of sadomasochistic.
“Clearly, there seemed to be pain,” Bucklew said.
That was acting, Benjamin said. “The person that was involved in the conduct sat [in court] with a smile on her face and wrote your honor a letter saying, ‘Judge, this was a beautiful part of my life.’”
“I don’t even think this is a close call,” the judge said. The videos portrayed “sadistic conduct … This is clearly degrading, clearly humiliating and intended to be so.”
There was no suggestion that any serious violence was ever inflicted or that the adult actors in the film were anything other than completely consensual. But the court found that the depiction of severe pain was not required for conviction; instead, mere humiliation and degrading treatment was sufficient to render the films criminal and to warrant a long prison sentence. As the judge put it: “This is clearly degrading, clearly humiliating and intended to be so.” So, having already bankrupted Little with the DOJ’s prosecution, it’s now off to federal prison — for the next 4 years of his life.
But for our highest government officials, including the ones responsible for this prosecution, we have a different story altogether. In 2002, the Bush DOJ radically re-defined “torture” and illegal treatment of detainees to exclude anything that falls short of “the pain accompanying serious physical injury, such as organ failure, impairment of bodily function, or even death.” The DOJ’s John Yoo even decreed that the President could legally order “‘scalding water, corrosive acid or caustic substance’ thrown on a prisoner” and possibly even “slitting an ear, nose or lip, or disabling a tongue or limb.”
But in all events, merely degrading or humiliating someone — or even subjecting them to severe mental stress and intense though temporary pain — magically became perfectly legal. And just to be sure, our Congress retroactively immunized anyone and everyone in the Government who may have been involved in any state-sanctioned line-crossing behavior even after the lines were radically re-drawn, so that this, from the U.S. Army’s own investigation of Guantanamo, was and is perfectly legal behavior — when engaged in for real by the U.S. Government against helpless detainees, but not by film-makers doing it for entertainment with consenting adults:
Mohammed al-Qahtani, detainee No. 063, was forced to wear a bra. He had a thong placed on his head. He was massaged by a female interrogator who straddled him like a lap dancer. He was told that his mother and sisters were whores. He was told that other detainees knew he was gay. He was forced to dance with a male interrogator. He was strip-searched in front of women. He was led on a leash and forced to perform dog tricks. He was doused with water. He was prevented from praying. He was forced to watch as an interrogator squatted over his Koran.
He was deprived of sleep for almost two months, stripped, held on the floor and sexually abused by a female interrogator, forcibly hydrated with liquids while shackled to a chair and not permitted to go to the bathroom. His CCR attorney, Gita Gutierrez, reported that Mohammed was still suffering from the effects of his torture and abuse: He “painfully described how he could not endure the months of isolation, torture and abuse, during which he was nearly killed, before making false statements to please his interrogators.”
But, when the U.S. Government does it, none of it is “torture” because it is mere humiliation and mental distress and severe degradation — but not “serious physical injury, such as organ failure, impairment of bodily function, or even death.” So, to recap, in the Land of the Free: if you’re an adult who produces a film using other consenting adults, for the entertainment of still other consenting adults, which merely depicts fictional acts of humiliation and degradation, the DOJ will prosecute you and send you to prison for years. The claim that no real pain was inflicted will be rejected; mere humiliation is enough to make you a criminal. But if government officials actually subject helpless detainees in their custody to extreme mental abuse, degradation, humiliation and even mock executions long considered “torture” in the entire civilized world, the DOJ will argue that they have acted with perfect legality and, just to be sure, Congress will hand them retroactive immunity for their conduct. That’s how we prioritize criminality and arrange our value system.
TOKYO, Japan (AP) — Police have apprehended a Western man who went skinny dipping in a moat ringing the Imperial Palace in a busy Tokyo business district, attracting a huge crowd, officials said Tuesday.
The naked middle-aged man jumped into the moat, then threw rocks and splashed water at two policemen who chased him in a rowing boat, a Tokyo Metropolitan Police official said on condition of anonymity, citing protocol.
The police official did not know the man’s name or nationality. Public broadcaster NHK and Kyodo News agency said the man is believed to be a 40-year-old Briton living in Spain who visited the moat with several Spanish friends.
Local TV footage showed the man swimming around the moat as the police chased him with a long stick, attracting a crowd of onlookers. He was in the water for about an hour.
He eventually got out of the water and climbed a stone wall only to fall into the hands of police waiting for him. The police official said the man was detained for questioning, but could not confirm if he was arrested or charged.
Broadcasters were careful to meet Japan’s obscenity laws once he had climbed out of the water, masking images of his private parts with a blurry dot.
“If you know what is within the moat, you won’t go skinny dipping there,” he said, referring to Emperor Akihito, who lives in the palace. The moat is separated from the emperor’s residence by high stone walls and woods.
A palace official said the emperor was in the palace, but it was unlikely he saw the nude swimmer. He also spoke on condition of anonymity in accordance with palace policy.
A suburban Pittsburgh teenager tried to kill his sleeping family by placing homemade chlorine bombs while they slept, police said.
Christopher Janney, 16, of South Fayette, was charged with attempted homicide for leaving what police described as “chlorine compression bombs” near the heads of five family members while they were asleep. Janney is being charged as an adult.
Police said the six devices were made of clear bottles with white powder that smelled of chlorine. The bottles did not explode and no one was injured.
Janney’s mother, Bonnie, told WPXI-TV that her son “has mental problems,” but that she did not think he would do anything to hurt her. A person who answered the phone at the family’s home told The Associated Press no one would comment.
The one-page complaint spelled out some details of what family members told police, but did not explain Janney’s purported motive.
Linda Hippert, superintendent of South Fayette School District where Janney is a high school junior on the soccer team, called the incident shocking.
She described Janney as “just what I would call your regular everyday student, and by that I mean not a student who was in trouble,” she said.
Police didn’t explain specifically how the bombs were assembled or what kind of injuries they were capable of causing.
“It’s an open investigation. We don’t want to jeopardize what we’re doing,” South Fayette Police Chief Louis Volle said Tuesday. “We’ve got a lot of unanswered questions.”
Sgt. Al Wessel of Allegheny County’s bomb squad told KDKA-TV that he did not believe such devices would kill, but said they could cause serious burns and possible blindness.
The criminal complaint also said that Janney had used a peppermill to grind up rat poison. It did not indicate whether he tried to use the rat poison on his family.
Police said they recovered a chemical gas mask, and text messages and e-mail from a computer and cell phone in Janney’s home. He had asked at least one person how to mix chemicals and wrote, “I went through with my plan,” the complaint said.
The teen was arrested Sunday, but Volle wouldn’t say where or how. The complaint said Janney and an accomplice planned to leave town by bus.
Janney is charged with five counts each of attempted homicide and one count each of reckless endangerment and criminal conspiracy.
Janney remained in jail Tuesday afternoon and it wasn’t clear if he had an attorney. He has a preliminary hearing scheduled for Wednesday in Pittsburgh at which he could either present a defense attorney or have one assigned to him by a judge.
ROME (Reuters) – An Italian woman who worked as a part-time judge as well as a lawyer was substituted by her identical twin sister in court so she would not lose out on legal fees when she had two simultaneous engagements.
The 54-year-old twins from northern Italy have now been charged with fraud and will go on trial in January, Italy’s leading newspaper, Corriere della Sera, reported Friday on its website.
One of the twins, identified only as Gabriella, worked primarily as a lawyer but also as an honorary judge, a part-time, paid position that entails helping full-time judges when their case load is heavy.
When Gabriella was called to be a substitute judge she sent her sister twin Patrizia to stand in for her at an existing engagement as a defense lawyer elsewhere in the Milan area.
The problem was that sister Patrizia was not a lawyer like sister Gabriella but charged the clients anyway.
The clients discovered the sister act and are now suing both for damages. Prosecutors have charged both with fraud, the paper said.
MADRID, Spain – Spanish police arrested 121 people in the country’s biggest-ever crackdown on child pornography, seizing discs containing millions of video and photo files shared by a network that distributed them in 75 countries, authorities said Wednesday.
Two of the suspects produced pornographic material themselves using members of their own families, police said in a statement. Those arrested came from all kinds of backgrounds, including pilots, salespeople, porters, taxi drivers and bank employees, it said.
The arrests were made last week and four of those in custody are minors, police said.
Brazilian police helped with the operation, which began in July 2007. A further 96 people have been named as suspects in the case, which involved raids on more than 250 homes across Spain.
Some of the videos and photographs that were seized featured extremely disturbing material, police said.
Most of the suspects are Spaniards, police said without naming the other nationalities. Police said the detainees used peer-to-peer, or P2P, servers to share at least three download sites.
Spanish authorities said they have arrested more than 1,200 people in connection with child pornography on the Internet in the last five years.

Former Melrose Place cougar Heather Locklear picked the wrong place for a meltdown this weekend.
The small-screen star was arrested around 5 p.m. Saturday after California Highway Patrol officers found her parked car blocking traffic in Montecito, Calif., a tony enclave near Santa Barbara.
According to the incident report, a “concerned citizen” called police after witnessing Locklear, 47, “driving forwards and backwards over a pair of sunglasses and revving her engine” in a parking lot.
The witness then came upon Locklear again on the road.
“The citizen became concerned when Ms. Locklear exited her vehicle and stumbled into the traffic lane…the citizen called 911 and reported the entire incident to CHP Ventura Dispatch.”
When officers arrived Locklear appeared disoriented, per the report, and after giving her a sobriety test they determined she was not suffering the side effects of a booze binge.
“Although obvious impairment was exhibited during the tests, alcohol was ruled out as a factor,” the CHP said in a statement. Locklear was arrested for suspicion of driving under the influence and taken to the Santa Barbara CHP office.
“She was evaluated by a drug recognition expert, who concluded Ms. Locklear was under the influence of a controlled substance, and could not safely operate a motor vehicle,” CHP said in a statement.
Locklear’s publicist declined to comment on the arrest.
The former Spin City fixture was booked at the Santa Barbara County Jail. She was released at 11 p.m. Saturday on $5,000 bail.

The white race must be pacified and civilized for the betterment of the planet. This will become a reality as enlightened whites shed their racist heritage and rejoin the human race as equals.
